Terms of Service

Please read these Terms of Service ("Terms") carefully before using our website and placing an order with Lytton Rose Botanical. By accessing our website and making a purchase, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or purchase our products.

1. General

a. Eligibility: By using our website and placing an order, you represent that you are at least 18 years old (or have permission from an appropriate adult) and have the legal capacity to enter into a contract.

b. Accuracy: You agree to provide accurate and up-to-date information when placing an order. We reserve the right to cancel or refuse any orders if we suspect fraudulent activity or incorrect information.

c. Product Descriptions: We make every effort to provide accurate and detailed descriptions of our products. However, please note that variations may occur due to the handmade nature of our products. Colors and sizes may also appear differently on different screens. Flowers, foliage, and wood are seasonal products. Sometimes stocks of materials can run low. If this happens we will substitute it with something of a similar value and look if we feel the overall design is not impacted by the substitution (see 2a). 

d. Intellectual Property: All content on our website, including images, designs, and text, is protected by intellectual property rights and may not be used without our prior written consent.

e. Credit: Lytton Rose Botanical retains the right to be credited for any floral design work provided. Where our designs or arrangements are shared publicly, whether in social media posts, press, or other media, Lytton Rose Botanical should be acknowledged as the floral designer using the handle @lyttonrosebotanical.

Clients agree not to present work created by Lytton Rose Botanical as their own, either in part or in whole. While we recognise and respect collaborative efforts (e.g., incorporating client-dried or client-sourced wholesale florals), our contributions must be communicated accurately when shared publicly. Credit to Lytton Rose Botanical should appear clearly and be given primary acknowledgment where relevant.


2. Ordering and Payment

a. Product Availability: All orders are subject to product availability. Flowers, foliage, and wood are seasonal products. Sometimes stocks of materials can run low. If this happens I will substitute it with something of a similar value and look. In the event that we are not able to create a similar enough product to the listing, we will notify you and provide a refund or offer an alternative solution. 

b. Pricing: Prices for our products are listed on our website in UK pounds (£) and include applicable taxes. We reserve the right to change prices at any time without prior notice, but such changes will not affect orders that have already been accepted.

c. Payment: We accept payment through Shopify. By providing payment information, you represent that you are authorized to use the selected payment method.

d. Order Acceptance: Once you place an order, you will receive an order confirmation email. This email does not constitute acceptance of your order. We reserve the right to accept or decline your order at our sole discretion. In the event of order cancellation, we will provide a refund.

3. Shipping and Delivery

a. Shipping: We offer to ship to addresses within mainland UK (excluding NI), Isle of Man and Jersey only. Shipping costs and estimated delivery times are specified during the checkout process. Please note that delivery times may vary due to factors beyond our control.

b. Risk of Loss: The risk of loss or damage to products passes to you upon confirmed delivery. Please inspect the package upon receipt and notify us of any issues within 48 hours.

c. Use of Safe Spaces: We recommend you are in to take delivery of your flowers wherever possible. If you request your flowers be left in a nominated safe place, Lytton Rose cannot be held responsible if your parcel is subsequently damaged or stolen. Please ensure any safe spaces used are weatherproof and secure to avoid such loss or damage. You can opt out of safe space deliveries on the Royal Mail website.

4. Cancellation, Returns and Refunds

a. Returns: We want you to be satisfied with your purchase. If you wish to return a product, please contact us within 7 days of receiving the item to initiate the return process. Returned products must be unused, in their original condition (including any bouquet wrapping/ribbons), and include all original packaging where possible. Returns are accepted on a goodwill basis only, due to the perishable nature of dried flowers. We reserve the right to refuse a return if a period over 7 days has passed since the item was delivered. Refunds will not be given for any personalised/written cards or personalised wooden tags.

b. Refunds: Once we receive the returned product and verify its condition, we will process the refund using the original payment method. Shipping costs are non-refundable unless the return is due to damage in transit or our error. Items must be re-packaged in the same manner as they were sent and customers are liable when returning items for any loss in value if the item arrives back to us damaged. The customer is responsible for claiming for any return shipping damages with their mail carrier.

c. Cancellation: I accept cancellations of most products up until the point the item has been marked as dispatched. At this point, my returns policy will apply.

d. Forced returns: If an item is returned to us due to refusal or non-collection, refunds will only be issued if the item returns to us within 2-3 weeks of dispatch. Any orders arriving back to us after this date will be processed minus the cost of materials as due to the perishable nature of the goods, I am not able to resell them. I recommend contacting me first and purchasing new shipping labels rather than refusing delivery, should you wish to return your item, as Royal Mail often hold onto parcels for quite some time. Customers are responsible for new outgoing postage for any requested re-delivery.

Cancellation of Bespoke Wedding Flowers

e. Cancellations more than 12 weeks prior to the wedding date will receive a refund on all money paid other than a non-refundable deposit of £50. Cancellations within 2-6 weeks of the wedding date will be refunded less deposit and costs for services and products already provided.

Refunds for cancellations requested less than 2 weeks prior to the wedding date are at the discretion of Lytton Rose and will depend on how much work has been done on the collection at that point and whether another buyer can be found for the items.


5. Limitation of Liability

a. To the extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of our website or products.

b. We make no warranties or representations regarding the accuracy, reliability, or completeness of the content on our website. You acknowledge that any reliance on such content is at your own risk.

c. Where floral installations, arrangements, or decorative pieces are installed by the client or a third party, Lytton Rose Botanical accepts no responsibility for any damage, breakage, loss, or injury arising during or after installation.

The client (or their appointed installer) assumes full responsibility for:

-The safe and correct installation of all items
-The suitability, stability, and load-bearing capacity of any frame, structure, or fixing used
-Environmental conditions including but not limited to wind, rain, humidity, and temperature
-The use of appropriate protective clothing during handling and installation

Lytton Rose Botanical shall not be held liable for any damage resulting from improper installation, unsuitable structures, adverse weather conditions, or handling after delivery.

Where frames or structures are not supplied by us, we make no guarantees as to compatibility or suitability for use.

 



6. Indemnification

You agree to indemnify and hold us harmless from and against any claims, damages, liabilities, costs, and expenses arising out of

or in connection with your use of our website, violation of these Terms, or infringement of any rights of a third party.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Changes to the Terms

We reserve the right to update or modify these Terms at any time without prior notice. The updated version of the Terms will be indicated by an updated "Effective Date." Your continued use of our website after any modifications constitutes your acceptance of the updated Terms.
